Living Trusts

Living trusts can be a helpful tool when considering how to structure your estate or dispose of your property. Some clients find that the work that goes into creating a living trust and the work required to maintain their property in that trust alleviates a lot of guess work and burden on their families when they pass away, which may do away with the need to have a formal probate proceeding.

For clients who choose to plan their estate with a living trust, it is still highly recommended that clients have the following other estate planning documents drafted and in place:

  • Wills
  • Medical powers of attorney
  • Statutory durable powers of attorney
  • Declaration of guardian in the event of a person's incapacity
  • An appointment of agent to dispose of your remains
